Yufuphone Terms & Policies

Yufuphone ("Yufu.net") is a mobile application which serves as a link between Customers ("Customer" or “User” or ‘you”) and registered translators and interpreters (“Translator”). This Terms & Policies refer to the services available within the Yufuphone app (“Yufu.net”, the “app”), including the third party services which are powered by Yufuphone’s technology, as the “Services”.

The whole functioning and development of the app is maintained by the Hong Kong Company, YUFU.NET LIMITED (HK). Payment collection, tax payments, and distribution within China is maintained by the China Mainland company, Yufu.net Co., Ltd, which acts as an agent on behalf of Yufu.net Limited (HK). Service payments beyond China’s borders are accomplished by UK Company M&N Finance LTD, which acts as an agent on behalf of Hong Kong Company Yufu.net Limited. The Terms & Policies presented below constitutes a binding agreement between the Hong Kong Company Yufu.net Limited (“App” or “Yufuphone”) and the User.This agreement is considered concluded in the location of the Yufu.net Ltd (HK) agent, namely in UK or China.

The following Terms & Policies govern the use of the Yufuphone application ("App") and the purchase of the services ("Services") available on the App by Users through this App.

By registering for or using this App, you acknowledge you have read, understood, and agree to the terms and policies ("Terms and Policies", “Terms”) set out below (including the privacy policy and refund policy). When you use our Services, you also agree to the Terms & Policies and they affect your rights and obligations. You can choose not to use the Services, if you don’t want these Terms & Policies to apply.

Information provided through the App is provided in good faith, and is subject to amendment at any time without notice. We may revise and reissue these Terms, by posting updated Terms on this page. You should visit this page regularly to review the current Terms & Policies. If you do not agree to the updated Terms, you should stop using our Services and/or close your account. Your continued use of any of our Services will be deemed as your acceptance of any revisions.

You should make your own evaluation of the accuracy or completeness of any information, opinion, advice or other content and link available through the website (yufuphone.com) or App.

1User’s Account Registration

1.1
In order to access the Services you must register / create an account ("Account"). If you create an Account, you agree that you will provide complete, current and accurate information about yourself as requested, and that you will keep this information up to date. The information required to be provided may include: (a) Personal information, including phone number and email; (b) Billing information; (c) Any other information reasonably required to complete your order. This information will be shared as described in Privacy Policy.

1.2
Email verification. Customer is asked to verify the email address used for the Yufuphone account creation. Email verification is an important precaution to be sure the Account is created by you. All important and relevant information will be sent to the Customer’s verified email address. The Customer is obligated to follow up on messages and any other changes sent to the email address. All notifications, confirmations, complaints and other information sent by Yufu.net to the Customer or sent by the Customer to Yufu.net is considered as received, authentic, and timely only if sent to or from this email address. Customer may deny to verify an email address, though, in this case customer takes full responsibility for all possible consequences. Once you verify your email address, it cannot be changed.

1.3
Mobile Phone Number Verification. In order to avoid fraudulent account creation, to increase your account security, and to make the Service possible, Customer is asked to provide and to verify the mobile phone number. Once you verify your phone number, it cannot be changed.

1.4
By registering, you get your User’s Account for convenient operation within the system. You are responsible for the confidentiality of the username and password which you use to access your Account. You agree not to disclose your username or password, or any other Account’s information to any third party. You agree that you are fully responsible for any activities or actions taken under your Account.

1.5
To use the Yufuphone services, User is asked to top up the Account balance and provide certain information related to service purchasing, including payment methods and other information. This information will be treated as described in the Privacy Policy. All billing information provided by User to any third party payment processing entities ("Payment Processor") must be accurate, current and complete. Yufu.net does not collect, store or share Users’ credit card or other billing information. User agrees to pay any charges incurred by User or any user of the same account and credit card (or other applicable payment method).

1.6
User indemnifies us against any actions, claims, suits, demands, liabilities, costs or expenses arising out of or in any way connected to use of the Services by the User or any other person using the User’s Account.

2Terms of Use

2.1
To access the Services, you will be asked to provide true and complete registration details. If we believe the details are not correct, current, or complete, we have the right prevent you from accessing our Services, and to terminate or suspend your account. The person under the age of consent in his / her country to form a binding agreement is not eligible to create an Account and use the Services.

2.2
We make no representation that our Service is available for use or permitted by law in any particular location. To the extent you choose to access our Service, you do so at your own initiative and are responsible for compliance with any applicable laws, including but not limited to applicable local laws. You are responsible for complying with local laws, if and to the extent local laws are applicable.

2.3
You may only use our Service and its contents for lawful purposes and in accordance with applicable law and you are prohibited from storing, distributing, or transmitting any unlawful material through this Service, otherwise you may be exposed to criminal and/or civil liability. You agree that if a third-party claims that material you have contributed to our Service is unlawful, you will bear the burden of establishing that it is lawful.

2.4
If you create an Account by selecting a password and providing your email and a mobile phone number, you are responsible for all activities that occur under your Account. You agree to notify us immediately of any unauthorized use of your user Account or any breach of security with respect to your Account including your password. Yufu.net will not be liable for any loss that you may incur as a result of someone else using your Account, either with or without your knowledge. In addition, you may be held liable for any losses incurred by us or another party due to someone else using your User Account.

2.5
Third-Party Services. The Service involves other third party service providers which cooperate with us to provide you certain Services, such as freelance Translators and mobile operators. These services are not under the control of Yufu.net, and you acknowledge that (whether or not such service providers are affiliated in any way with Yufu.net) Yufu.net is not responsible for the accuracy, legality, decency, or any other aspect of their services.

2.6
Trial Version. Each registered User registered on the app (except Translators) may try the Service for free. The volume of the services you may use for free is limited to the size of the balance you get for trial version from Yufu.net when accomplish registration. The amount given to you for trial as well as the services available for the trial may be changed anytime by Yufu.net without notice to you. The trial option is given to User to check whether he / she is satisfied with the Service or not, as well as to check if the app is operating correctly on his / her device, before start using charged services. We highly recommend User to try trial Service before topping up the Yufuphone balance. If you are not satisfied with any aspect of the app during trial version, please do not top up your Account’s balance. The trial balance may not be withdrawn by the User and may be used within 30 calendar days after registration. If the trial balance is not used up or used up partially within the said period of time, the full amount of the rest of the trial balance will be cancelled automatically.

2.7
Service Availability. User can check the services available, including language pairs, offered call destinations, and other related information directly on the app. It is User’s responsibility to check the availability of the Service before topping up the balance.

2.8
Reservation of Rights. Yufu.net reserves the right to modify or discontinue, temporarily or permanently, all or any part of this Service and/or any software, facilities, and services on this Service, with or without notice and/or to establish general guidelines and limitations on their use.

2.9
User’s Account Cancellation. If your User’s Account is deactivated, your Account’s balance will be lost. For this purpose, your Account may be deactivated in any of the following: (i) you actively deactivate your Account. (ii) You do not log in to the app for twelve consecutive months (iii) Yufu.net believes your behavior was malicious, for example, you intentionally marked down the rating of the Translator.

2.10
Devices and Operational Systems. The Yufuphone app is intended only for applying to the devices with the operational system iOS latest and above or Android 6 and above. User must understand that even using the operational systems mentioned above, the technical behavior of the app, therefore the quality of the Service may be different, when using on different devices. It is User’s responsibility to be sure applying correct operational system and to check the app suits to the device. We highly recommend not to use up your trial option and not to top up your balance, when you are planning to use the app on another device, unless you are sure another device ensures the app’s normal operation.

2.11
Violation of Security Systems. You are prohibited from using any services or facilities provided in connection with this Service to compromise security or tamper with system resources and/or accounts. The use or distribution of tools designed for compromising security (e.g. password guessing programs, cracking tools, malware, or network probing tools) is strictly prohibited. If you become involved in any violation of system security, Yufu.net reserves the right to release your details to system administrators at other sites, law enforcement and/or governmental authorities in order to assist them in resolving security incidents.

3Terms of Service

3.1
Placement of an order ("Order"). In order to access certain services the Customer is required to register/create an account ("Account") in our system and complete the order by following the steps provided on the App. If Customer creates an Account, he / she agrees to provide information reasonably required to complete the order.

3.2
By placing an Order the Customer acknowledges and agrees to prices, including prices of value added services, terms of use, terms of implementation and other information provided on the App, agrees to provide all required information and respect Yufu.net Terms and Policies. The Customer holds full responsibility for the authenticity, accuracy, and correctness of all provided information, including personal data and Order parameters.

3.3
To order the Services, Customer is asked to provide certain information related to Service purchase, including payment methods and other information. This information will be treated as described in the Privacy Policy. All billing information provided by Customer to any third party payment processing entities ("Payment Processor") must be accurate, current and complete. Yufu.net does not collect, store or share Customers’ credit card or other billing information. Customer agrees to pay any charges incurred by Customer or any user of the same account and credit card (or other applicable payment method).

3.4
The prices, terms of use and other related information placed on the App is open and available to Users any time. We may amend these terms at any time by publishing revisions to the App without any prior notification. The amended terms will take effect from the published time on the App.

3.5
If Yufu.net concludes that the order is inappropriate, the order may be cancelled or not confirmed by Yufu.net. In this case Customer may cancel an order for a refund.

3.6
Service Providers. Yufu.net ensures the app functioning and development. Other services available on the app are provided by third party service providers. There are two main types of services on the app offered by third party service providers: “Voice translator”, “Conference call translator”, and “Text and photo live translator” refer to translation services (“Translation Services”); “International calling”, “International call forwarding”, and “International phone numbers” refer to call services (“Call Services”).

3.7
The Quality of Connection. The quality of the Services significantly depends on the quality of connection. The quality of connection depends on the mobile internet or Wi-Fi you are using or / and the technical condition of your device. It is user’s responsibility to make sure the both conditions mentioned above can ensure a stable and satisfying operation of the app on his / her device. The user can see the rating of connection on the app from 1 to 5 points. We do not recommend to use the Service, if the current rating of connection quality is lower than 3 points.

3.8
Translation Services.

3.8.1
Translation Services are supported by freelance translators and interpreters, thus Yufu.net does not take responsibility for the translation quality, correctness, or translator’s attitude. Nevertheless, we do our best to protect you from unfair translators. For example, we give you a trial option, translation quality rate option, and claim option which are explained herein.

3.8.2
“Voice Translator” and “Conference Call Translator” Call Record. In order to indemnify Translators and Customers against malicious attempts and further consequences, all phone calls between Customer and Translator are recorded. The record is checked only in case the Customer rated translation service quality of under 40%. If we decide your rate was fair, you can claim for partial or full payment refund (see Refund Policy); if we decide your rate was unfair, your behavior is regarded as malicious, and your User Account will be cancelled. The call record check may take up to 7 days. If the call lasted for over 9 minutes, the call will not be checked, even if the User rated the service from 0% to 39%.

3.8.3
“Voice Translator” and “Conference Call Translator” Service Rate Option. You can rate the quality of translation service each time you use the services mentioned above. If User does not rate the service, the default rate is 80%. The rating range from 40% to 100% is considered as acceptable, and User is charged normally; the rating from 20% - 40% is considered as unsatisfactory, and the User may claim for the partial refund. The rating of under 20% is considered as low quality, and the User may claim for the payment refund. If the call with Translator lasted for over 9 minutes, the rate from 0% - 40% is regarded as User’s malicious behavior.

3.8.4
“Voice Translator” and “Conference Call Translator” Services Refuse. During an Order, Translator may terminate the Service, if he / she believes your behavior is inappropriate. You may express your disagreement by rating his / her service from 0% to 19%. In this case, the voice call record will be checked. If we find Translator’s behavior or translation were unacceptable, you may claim for payment refund.

3.8.5
The rates for Translation Services via phone call consist of per minute rate. The duration of a call shall be based on one-minute increments. Fractions of minutes will be rounded up to the next minute. At the end of a call, fractional cent charges will be rounded up or down to the nearest whole cent. During the call, charges incurred will be deducted automatically from your User Account balance. The rates for “Text and photo live translator” consist of per fixed amount of characters (including spaces). For different languages the cost of the same amount of characters may be different.

3.8.6
“Text and Photo Live Translator” Service Refuse. Translator may refuse to perform your order, in any of the following: (i) the quality of the image is not clear (ii) the amount of characters you said exceeds the actual amount of characters on the image (iii) the original text you sent has no logic meaning. (For payment and refund process, please check “Payment Policy” and “Refund Policy.)

3.8.7
“Text and Photo live translator” Claim Mistake Option. If Customer finds a serious mistake in the translation order, he / she may use claim option within 7 calendar days after Order’s day. Your claim will be investigated by the group of translators, if we believe your claim was fair, your payment will be refunded within 7 work days; if we believe your claim was unfair, Yufu.net has a right to cancel your account for the malicious behavior.

3.9
Call Services. Call Services are provided by the third party service provider, thus Yufu.net does not take responsibility for the Service quality. To use the Service the User may be asked to provide and confirm an additional information, such as name, ID card / passport, and other information required by the law. This Service incurs additional expenses, such as subscription fee etc.

3.10
Termination. You may terminate your relationship with Yufu.net at any time, requesting that Yufu.net delete your account. Yufu.net has the right to terminate your rights under our Service without notice.

3.11
Disclaimer of Warranties. Although we make great efforts to make our Service error and interruption free, we cannot promise that such efforts will result with such desired performance. YOUR USE OF THIS SERVICE IS AT YOUR OWN RISK. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY US SHALL CREATE A WARRANTY. YUFU.NET DOES NOT WARRANT THAT ANY SERVICE AVAILABLE ON THE APP IS ALLOWED OR NOT LIMITED TO USE IN YOUR COUNTRY OR REGION. THE SERVICE AND ALL THE MATERIALS, INFORMATION, SOFTWARE, FACILITIES, SERVICES AND OTHER CONTENT IN THE SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. YUFU.NET DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED ON OR THROUGH THIS SERVICE WILL BE AVAILABLE, UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR THE SERVERS THAT MAKE THE SERVICE AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YUFU.NET DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE MATERIAL, INFORMATION, SOFTWARE, FACILITIES, SERVICES, OR OTHER CONTENT ON THE SERVICE OR ANY WEBSITES LINKED TO THE SERVICE IN TERMS OF THEIR CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE. YUFU.NET MAKES NO WARRANTIES THAT YOUR USE OF THE MATERIALS, INFORMATION, SOFTWARE, FACILITIES, SERVICES, OR OTHER CONTENT OF THE SERVICE WILL NOT INFRINGE THE RIGHTS OF OTHERS AND THE YUFU.NET ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ERRORS OR OMISSIONS IN SUCH MATERIALS, INFORMATION, SOFTWARE, FACILITIES, SERVICES, OR OTHER CONTENT OF THE SERVICE OR ANY OTHER WEBSITE. IF APPLICABLE LAW DOES NOT ALLOW THE EXCLUSION OF SOME OR ALL OF THE ABOVE IMPLIED WARRANTIES TO APPLY TO YOU, THE ABOVE EXCLUSIONS WILL APPLY TO YOU ONLY TO THE EXTENT PERMITTED BY APPLICABLE LAW.

3.12
Limitation of Liability. YUFU.NET DISCLAIMS ALL LIABILITY, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, AND DOES NOT ACCEPT ANY LIABILITY FOR ANY LOSS OR DAMAGE (DIRECT, INDIRECT, PUNITIVE, ACTUAL, CONSEQUENTIAL, INCIDENTAL, SPECIAL, EXEMPLARY, OR OTHERWISE) RESULTING FROM ANY USE OF, OR INABILITY TO USE, THE SERVICE OR ANY OTHER SITE, APP OR SERVICE, OR THE MATERIAL, INFORMATION, SOFTWARE, FACILITIES, SERVICES, OR OTHER CONTENT ON THE SERVICE OR ANY OTHER SITE, APP OR SERVICE, REGARDLESS OF THE BASIS UPON WHICH LIABILITY IS CLAIMED AND EVEN IF ANY MEMBER OF THE YUFU.NET HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE. WITHOUT LIMITATION, YOU (AND NOT ANY MEMBER OF THE YUFU.NET) ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, OR CORRECTION IN THE EVENT OF ANY SUCH LOSS OR DAMAGE ARISING THEREIN. IF APPLICABLE LAW DOES NOT ALLOW ALL OR ANY PART OF THE ABOVE LIMITATION OF LIABILITY TO APPLY TO YOU, THE LIMITATIONS WILL APPLY TO YOU ONLY TO THE EXTENT PERMITTED BY APPLICABLE LAW.

3.13
Indemnity. You agree to indemnify and hold harmless The Yufu.net from and against any and all claims, demands, liabilities, costs or expenses, including reasonable attorney’s fees, resulting from your breach of these Terms, including any of the foregoing provisions, representations or warranties, from your placement or transmission of any content onto Yufu’s servers and/or from any and all use of your User Account.

4Payment Policy

4.1
Yufu.net Payment Policy is performed in accordance with the following items and the description available on the App. All prices, terms of use and other related information placed on the App is open and available to Users any time. We may amend these terms at any time by publishing revisions to the App without any prior notification. The amended Terms will take effect from the published time on the App. In the case of alterations to the Payment Policy, the Terms in effect at the time of Service purchase will be applied to payments.

4.2
Each User Account on the Yufuphone app has its own private (or corporate) account and balance. The default currency of use in this account is Chinese Yuan (CNY) except where otherwise noted. Negative balances will result in suspension of services until the Customer top- up the balance.

4.3
Account Top-up. You can top-up your User Account balance using any payment method made available to you by Yufu.net. Once you to up your User Account balance, you cannot withdraw the payment. Account balance may be used solely for the Service offered by the app. We use the services of third parties to process your payments and we require that these third parties take the appropriate organizational and technical measures to protect your personal data and traffic data and to comply with relevant laws. Please review the terms of use and privacy policies of those third parties before providing your banking or payment information. You can change your payment method and billing information by logging into your Yufuphone account. You agree that Yufu.net may use information regarding your selected payment method provided by your issuing bank or applicable payment system. If you pay with foreign currency, you agree that the amount you are eventually credited may vary, as a result of foreign currency conversion policies of our third party payment processors, which you can find at the relevant website or location where you make the actual purchase.

4.4
Charges for the Services. The Yufuphone app implements different charge principles, as charge per minute, per character (including spaces), weekly, monthly, and annually subscription plans, etc. The rates and / or final cost is always shown to the user before or at the moment he / she starts to use the service. If user uses the service he understands the rate and the principles of the price forming. If you do not understand the rates and the final price forming, please do not use our services.

4.5
Yufu.net may change the rates at any time without notice to you. The new rate will apply to your account next time you purchase the Service after the new rates have been published. Please check the latest rates before you use the service. If you do not accept the new rates, do not use the service.

4.6
The rates for “Voice translator”, “Conference call translator”, “International calling”, “International call forwarding”, and “International number rate” consist of per minute rate. 4.7
Subscription fee. The “International calling”, “International call forwarding”, and “International number rent” incur subscription fee. Yufu.net has a right to set the period of time to be used as minimum subscription period. User may set the period of subscription, but it cannot be less than the minimum period asked, if there is any. If you use the service where incurs subscription fee, the amount said on the app will be deducted automatically from your User Account till the moment your subscription expires or the balance is not sufficient. It is user’s responsibility to timely unsubscribe, if you do not need the service anymore, or to timely top-up the balance.

4.8
Yufu.net does not imply automatic recurring charge for the Service. It is User’s responsibility to top up the balance in timely manner. User understands that, if the balance is insufficient the service cannot be delivered or may happen an unexpected service disconnection.

4.9
Gold Account. If you purchase a gold account, you agree that this type of Service requires a recurring payment and all payments shall be made by the payment method and payment intervals selected by you at the time you initiate the purchase, until you terminate the subscription. The subscription fee does not cover the cost of Service.

4.10
VIP Account. If you purchase a VIP account, you agree that this type of Service requires a one-time annual payment and all payments shall be made by the payment method and payment intervals selected by you at the time you initiate the purchase, until you terminate the subscription. The subscription fee does not cover the cost of Service.

4.11
Using the Service on mobile applications will use some of the data allowance available on the data package to which you have subscribed with your mobile network operator as the case may be. Out-of-country usage may in any event lead to significantly higher costs than regular usage, and you are responsible for precisely following the instructions provided on the website and the app to decrease expenses.

4.12
Yufu.net may collect VAT or other indirect taxes at the applicable rate for the particular country (as per applicable tax rules) at the time of top-up your Yufuphone balance or at the time you use the Yufuphone service.

5Refund Policy

5.1
Except as provided by law and the items mentioned in this Refund Policy, all purchases are final and non-refundable. If you believe that Yufu.net has charged you in error, you must contact Yufu.net within 30 days of such charge. No refunds will be given for any charges more than 30 days old. If you purchase any service from Yufu.net, any right you may have to withdraw from or cancel the purchase will terminate once the service has been delivered to you upon your request, and you will not be entitled to claim any refund.

5.2
The payment is 100% refundable in the following cases:
  1. You rated translation service from 0% - 19%, and the Yufu.net investigation proved that your rate was fair;
  2. Translator failed to send you translated file in 30 minutes after he / she confirmed an order;
  3. You informed us about a serious mistake you found in the translation you received, and our investigation proves that your claim is fair. You must claim within 7 days of the translation receiving. No refunds will be given for any charges more than 7 days old.

5.3
The payment is partially refundable in the following cases:
  1. You rated translation service from 20% - 39%, and the Yufu.net investigation proved that your rate was fair.

5.4
The payment is not refundable in the following cases:
  1. You rated translation service in the range from 0% - 39% or claimed about a serious mistake in the translation, but our investigation cannot prove that your rating or claim was fair;
  2. Your claim about a serious mistake in the translation exceeds 7 days;
  3. You rated translation service in the range from 0% - 39%, but your call with the translator lasted over 9 minutes;
  4. Any kinds of subscription fees;
  5. Payments for any other services available on the App, but not mentioned in this Refund Policy.

5.5
Time & Methods of Refund. The refund will be performed within 7 calendar days of the request receiving. Any issue, which makes the refund impossible at that moment, the refund period may be extended without notice to you. In case of 100% or partial refund, the payment will be refunded to the User’s Account balance. Any balance on your Account cannot be withdrawn, it can be used solely for the Yufuphone Service.

5.6
The Yufuphone Balance Top-Up. Once you top – up your Account balance or get your payment refunded to this balance, you cannot withdraw it. Any balance on your Account can be used solely for the Yufuphone Service.

5.7
The Yufuphone Balance Cancellation. Your Account balance may be cancelled in the following cases:
  1. You did not use the balance within 180 days;
  2. You did not log in to your Account for the 12 consecutive months;
  3. You voluntarily delete your Account;
  4. Yufu.net believes you intentionally rated translation service from 0% - 39% with no reason;
  5. Yufu.net believes you intentionally claimed about a serious mistake in the translation with no reason.

5.8
Yufu.net reserves the right to refuse a refund request if it reasonably believes or suspects (i) that you are trying to unfairly exploit this refund policy, for example, by making repetitive refund requests in respect of the same product or feature; (ii) that you are in breach of the terms of this License; (iii) that you are using any of our products fraudulently or that your User Account is being used by a third party fraudulently; or (iv) that you purchased your credit through a third party service and the terms of such third party do not allow such refund. This refund policy does not affect any of your statutory rights to pursue a claim.

6Privacy Policy

This policy details the Yufu.net methods for collecting and using User’s personal information and the User’s methods to control that information. Users unconditionally accept and agree to be bound by Yufu.net Privacy Policy.

6.1
Information we collect:

6.1.1
Registration and Account Information. For the account registration and when use certain services, we may ask to provide and to confirm the following information: email address, mobile phone number, password, User’s real name and surname, copy of the ID card / passport, prove of the address of your residence, billing information, and other information required for the Account creation, Service use, and the information required by the law. User is under no obligation to provide the data mentioned above, however in this case Yufu.net may refuse to provide the Service. When you install the Yufuphone App, you’ll also be asked to allow us access to your mobile device’s address book. A copy of the phone numbers and names of all your contacts (whether they’re Yufuphone users or not) will be collected and stored on our servers in order for us to be able to enable you and your contacts to connect. When you join Yufu.net, the contacts in your address book that are already Yufuphone users may be informed that you’re now on Yufuphone too.

6.1.2
Activity Information. While using the Yufuphone services, we will collect, whether you have received and seen messages sent to you, if you are currently on another call, and information related to the calls you have made and received. As for delivered status and call information (length of the call, missed calls etc.). We collect information about the services you are using over Yufuphone. We collect and may share the information with others Yufuphone users about how you rate the quality of translation service and your claim about mistake.

6.1.3
Voice Call Record with Translator. In order to provide better service and give you an option to get a refund in case of not satisfactory translation service quality, we record all calls where participate translator. If you rate the service of 40% and above, those records are never checked and are deleted from our servers after 30 days on order’s date. If you rate translation service quality under 40%, you give us a permission to check the records and share it with the group of other translators to make a final decision of the service quality.

6.1.4
Text & Photo Live Translation Content. The content you send via the App for the translation is shared with the group of translators of the language pair you choose. Translated content is shared only with you. In order to give you an option to claim about a serious mistake in the translated content, we store this content for the period of 30 days. This content is never checked, unless we receive a claim from you within 7 days on order’s date. If we receive the claim, this content will be shared with the group of translators in order to make a final decision of the translation correctness.

6.1.5
Information from Other Sources. The information we collect may be combined with information from outside records (e.g. demographic information and additional contact information) that we have received in accordance with the law.

6.1.6
Additional Information. We may collect additional information if you access our App through a specific device (e.g. your mobile device’s unique identifier; information about your device’s operating system, your browser, browser or operating system language; your wireless network, and your mobile carrier; the Yufuphone call log). We may also collect your WPS location data – you can choose whether to allow this by changing your geolocation tracking settings.

6.1.7
Log files/IP addresses. When a User visits the Yufuphone Website, its IP address is logged and recognized by the Yufu.net web server. Yufu.net uses IP addresses in order to manage the Website. We do not link IP addresses to personally identifiable information.

6.1.8
Cookies. When you visit the App and/or our Website, we may use cookies and other tracking technologies for a variety of purposes. These help to enhance your online experience, for example, by remembering your log-in status and viewing preferences from a previous use of our App when you return later. If you block cookies and tracking technologies you may not be able to access certain portions of our App. You may browse our site without telling us who you are, and we will obtain information about your computer or device (e.g., IP addresses) for the purpose of monitoring and improving our site and Services.

6.1.9
Non-personal information. Non-personal information such as browser type may be automatically collected by the Yufu.net. The User cannot be identified by this data, and it is used only to ensure effective operation of the App.

6.2
Yufu.net respects your privacy and is committed to protecting personal information shared with Yufu.net. Yufu.net does not collect or view any information on transaction details, including card numbers or other card data. All transactions are facilitated through the third party processing company.

6.3
Personal Information Storage, Confirmation, Change, or Deletion. When you create your User Account, please note, that all information provided by you is stored on the Yufu.net server, and you can access it anytime at www.yufu.net, using your email address or phone number and the password. The information we ask you to confirm, such as mobile phone number, email address, name, etc., cannot be changed. If you want to delete your Account, you can do it at www.yufu.net, but it does not guarantee that your personal or non-personal information will be completely deleted from our servers. Yufu.net will keep it the period of time required by the law. We may retain some information from closed accounts so that we can comply with law, prevent fraud, assist with investigations, resolve disputes, analyze, or troubleshoot programs, enforce our Terms of Use, or take other actions permitted by law. Likewise, if your account or membership is terminated or suspended, we may maintain some information to prevent you from re-registering.

6.4
Uses and Retention.

6.4.1
Make our service available. We use your Registration and Account information to (i) register you for the App and create your User Account for Yufuphone; (ii) process your payments; (iii) give you information about your account (iv) improve the Service (v) indicate which of your contacts is already a Yufuphone user (vi) display the name of the contact as it appears in your address book when a call is received on the Service, and (vii) sync your contacts with Viber running on Android and Apple devices (viii) increase the safety of your Account. If you deactivate your Yufuphone account, all User’s information will be deleted from our servers quickly and permanently. Otherwise, we keep your contact information for as long as you use the App.

6.4.2
Improve our Services. We use call log information and usage information to better understand network behavior and trends (numbers of messages and calls made by users, typical destinations, call lengths, network type, etc.), detect potential outages and technical issues to improve our Services. We may look into a specific call log in response to a customer support request. We maintain call log information for only as long as is needed for business and/or legal purposes.

6.4.3
Prevent Fraud & Enforcement of Law. We may use your information to prevent, detect, and investigate fraud, security breaches, potentially prohibited or illegal activities. We may use your information and call log information to comply with applicable laws.

6.4.4
Communicate With You. We may use your information to contact you (via message or other means) to maintain the App, to inform about payments or Account balance, or to provide updates about other Yufu.net services.

6.5
Disclosure.

6.5.1
Except as disclosed in this Privacy Policy, User’s personally identifiable information cannot be sold, rented, or retransmitted, unless it has been permitted by the User. Any personally identifiable information provided is used for your purchases and remains in our database system, except for invoice generation.

6.5.2
App Providers and Other Third-Parties. We may disclose your information to service providers and other third-parties under contract who help with providing you our Services or other services provided by third-parties via our Services (such as, but not limited to, fraud and spam investigations, payment processing, site analytics and operations, providing special partnership features in our service). They are required to secure the data they receive, so that your personal information is guarded.

6.5.3
Legal and Law Enforcement. We may disclose your information to law enforcement, governmental agencies, or authorized third-parties, in response to a verified request relating to terror acts, criminal investigations or alleged illegal activity or any other activity that may expose us, you, or any other Yufuphone user to legal liability.

6.5.4
Change of Control – New Owners. We may share your information with another business entity, if we plan to merge with or be acquired by that business, or are involved in a transaction with similar financial effect. In such a situation we would make reasonable efforts to request that the new combined entity or other structure follow this Policy with respect to your personal information. If your personal information was intended to be used differently, we would ask the new entity to provide you with prior notice.

7Governing Law / Dispute Resolution

7.1
Jurisdictional Issues. The Materials and all other content in this Service are presented for the purpose of providing information regarding the Yufu.net Services available in the Hong Kong Special Administrative Region and elsewhere.

7.2
Choice of Law. Any disputes arising out of or relating to these Terms and Conditions will be resolved under the Laws of The Hong Kong Special Administrative Region. All claims arising out of or relating to these Terms and Conditions will be litigated exclusively in the Xiamen Intermediate People’s Court of Fujian Province.

7.3
This Terms & Policy was written in English. To the extent any translated version of these terms conflicts with the English version, the English version controls.

8Entire Agreement

These Terms & Policies constitute the entire agreement between the parties in relation to their subject matter.

These Terms & Policies are in power as of 22:15 UTC on 25th of September, 2017.
